Terms of Service
These Terms of Service are applicable to your purchase of any membership or product from the School Comms Lab or Holdsworth Communications online. Other than as specifically provided in any separate written agreement between you and the School Comms Lab or Holdsworth Communications, these Terms of Service may not be altered, supplemented, or amended by the use of any document, such as purchase orders, and all sales are expressly conditioned upon your agreement to these Terms of Sale. In the event of any conflict between these Terms of Service and the other provisions of the Terms of Use, these Terms of Service will control. By purchasing any products on schoolcommslab.com, you, the Purchaser, are agreeing to these terms:
Refunds
Purchasing a School Comms Lab subscription/membership or a School Comms Lab digital products gives Purchaser unlimited access to restricted, members-only content (including digital downloadable content), and therefore we offer no refunds - all sales are final. However, we want you to be fully satisfied with your purchase. If for any reason you are not satisfied, please email us at hello@schoolcommslab.com and we will address your concerns. Refund requests made after membership access has been granted and Purchaser has logged in and accessed the contents in the subscription/membership, are handled on a case-by-case basis and may not be issued. Refund requests, if any, must be made within (3) days of your original purchase.
It is the sole responsibility of Purchasers/Members to log in, access and download the contents inside the School Comms Lab library and external links. No refunds will be given for Purchasers who choose NOT to log into their account, access the membership nor download the contents from stock library once access has been granted.
Refunds will not be issued for one-time, single downloadable products.
Due to the digital nature of online courses, refunds will not be issued.
Renewal & Cancellation
The School Comms Lab subscription/membership auto-renews monthly, quarterly or annually based on the membership level you have chosen at the time of checkout.
School Comms Lab members are responsible for cancelling their subscription with schoolcommslab.com via the Membership Account page. If you do not want your subscription to renew, you will need to cancel your membership BEFORE your renewal date which is shown in your Membership Account or receipt, upon which your subscription will continue until the end of your current term. Once your membership account has expired, access to the membership, stock library and its contents and courses will cease.
You may cancel your membership at any time, but please see the section above about refunds.
Limitation of Liability
This site and all information, content, materials, and products included on or otherwise made available to Purchaser through this site are provided by School Comms Lab/Holdsworth Communications on an “as is” and “as available” basis, unless otherwise specified in writing. School Comms Lab, Holdsworth Communications, nor Amanda Holdsworth makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials or products on or otherwise made available to you through this site. Purchaser expressly agrees that Purchaser’s use of this site is at your sole risk.
To the full extent permissible by applicable law, School Comms Lab, Holdsworth Communications, nor Amanda Holdsworth shall accept responsibility that the website, its servers, or email sent from the website are free of viruses or other harmful components. We will not be liable for any damages of any kind arising from the use of the website, including, but not limited to direct, indirect, incidental, punitive or consequential damages.
The contents of this site do not constitute advice and should not be relied upon in making, or refraining from making a decision. Purchaser further acknowledges that any information or materials on this site may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted.
Certain state laws do not allow limitations as contained in this clause. If these laws apply, some or all of the above limitations may not apply to you and you might have additional rights.
Product Download
Downloads from our servers are closely monitored to ensure you are able to successfully access our products. While we are flexible and allow you to complete a reasonable number of downloads we will not tolerate download abuse. We reserve the right to terminate your access to our download servers if we suspect any kind of abuse.
Once Purchaser has accessed downloads, Purchaser is encourage to download it promptly and to make a backup copy of it. If Purchaser is unable to complete a download after having reviewed the online help resources, Purchaser shall contact School Comms Lab’s customer service for assistance at hello@schoolcommslab.com. Purchaser bears all risk of loss after purchasing including any loss of the downloads as a result of downloading, or loss due to a computer or hard drive crash.
Once Purchaser has accessed templates, Purchaser is encourage to download it promptly and to make a backup copy of it. If Purchaser is unable to access a template after having reviewed the online help resources, Purchaser shall contact School Comms Lab’s customer service for assistance at hello@schoolcommslab.com. Purchaser bears all risk of loss after purchasing including any loss of the downloads/templates as a result of downloading, or loss due to a computer or hard drive crash.
School Comms Lab may, from time to time, remove downloads and template access from the website without notice.
Acceptance of Order
We reserve the right to refuse or cancel any order or custom photo request made at any given time. In such event, your sole recourse shall be the return of amounts paid by you related to such order (if any).
Electronic Communications
You consent to receive communications from us by email. You agree that all agreements, notices, disclosures and other communications that we provide to you by email satisfy any legal requirement that such communications be in writing.
Trademarks
Certain graphics, logos, page headers, button icons, scripts, and service names are trademarks, service marks, or trade dress of our company or our affiliated companies. Our trademarks and trade dress may not be used for any commercial or other purposes without our prior written consent. All other trademarks and service marks not owned by Alicia Powell, Pixistock, or our affiliated companies that appear on the website are the property of their respective owners and may or may not be used without their prior written consent.
Modification And Severability
We reserve the right to make changes to our website, our policies, our Terms of Use and these Terms of Service at any time and in our sole discretion. Therefore, you should review our policies, terms and conditions each time you visit the website. Your continued use of the website after we make any such changes constitutes your binding acceptance of those changes. If any of the terms or conditions herein shall be deemed invalid, void, or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforceability of any remaining term or condition.
Digital Image Usage and Licensing
Purchased photo downloads may be included as part of the initial service contract or purchased from Pixistock online store. Pixistock and Alicia Powell grants Purchaser a non-exclusive, non-transferable, perpetual limited-use license to download and copy the accompanying image(s) subject to the following restrictions: This license can be used for personal or commercial use; copyright, title ownership, and all rights now and in the future, remain exclusively with Alicia Powell. There are no warranties, express or implied. Photographs are provided ‘as is.’
Neither Pixistock nor Pixistock’s vendors will be liable for any third party claims or incidental, consequential or other damages arising out of this license or buyer’s use of our products.

Use the photographs in a pornographic, obscene, illegal, immoral, libelous or defamatory manner.
Scan, copy, duplicate, distribute, or otherwise reproduce the images, to allow a third-party to use the images in any way.
Use this purchase to promote photography styling related workshops, classes, or any on or offline photography-related training.
Incorporate photographs into trademarks, logos, or service marks.
Make available for download.
For GRAPHIC/WEB Designers:
You may use the images as part of a graphic design or web design project for an individual paying client.
You MAY NOT resell or freely distribute single images to your client, apart from a design project. Note that design projects are classified as digital or print projects that require MORE design elements than a single image, such as, a new website, social media design cover or print brochure.
You MAY NOT create derivative products from the images such as digital templates, screensavers, printables, desktop calendars, wallpapers, art prints, mugs, calendars, clipart/vectors, invitations, or any such products, either for sale or to give away for free. For example, these products are typically posted on multi-vendor websites like Society6, Envato or Creative Market.

By purchasing Canva, Photoshop, InDesign and/or Illustrator templates from School Comms Lab, User agrees and acknowledges that the templates come with an exclusive, limited use license.
“Limited use” refers to the following:
Amanda Holdsworth remains the sole holder of the copyright and User may not cite the image or design as User's own intellectual property. User acquires the right to possess, hold and use the templates for personal, or professional purposes for normal business uses.
User MAY:
User/member MAY use these templates to promote his/her own business, school or personal brand on or offline.
User/member MAY use these templates to sell his/her own, branded content to their audience and use for digital ads.
User/member MAY add user's own branding, text, colors, content and other design assets to the PDF guide template to RESELL as a pdf download content upgrade or lead magnet to his/her audience.
User MAY NOT:
User/member MAY NOT redistribute, resell, transfer or give away these templates to any third party, AS-IS.
User/member MAY NOT resell these templates on any mass marketplace website (Creative Market, Etsy, Envato, etc.) NOR resell as a digital template product on any other website or platform, whether AS IS, or edited.
User/member MAY NOT transfer, redistribute or give away any of these templates to a third party without adding additional branding, logos, content, text, color and/or additional design elements to the templates.
User/member MAY NOT use these templates to promote the sale of digital, graphic design templates, Canva templates or stock photography.
User understands that he/she may lose saved changes if User does not make a copy of these Canva templates into User's own Canva account before editing.
Copyright, title ownership, and all rights now and in the future, remain exclusively with Amanda Holdsworth. There are no warranties, express or implied. Templates are provided ‘as is.’
Amanda Holdsworth with School Comms Lab and Holdsworth Communications, LLC retains all rights, license, copyright, title and ownership of the templates and resources on schoolcommslab.com and in the membership site.

It is School Comms Lab’s policy to respect your privacy regarding any information we may collect while operating our websites. Website Visitors

School Comms Lab’s purpose in collecting non-personally identifying information is to better understand how School Comms Lab’s visitors use its website. Contact Forms
School Comms Lab would not use personal information of customers included in the “Contact Us” form in our website or e-mail query sent to our e-mail address (hello@schoolcommslab.com) for purposes other than to use contact address of customer in order to answer inquiry from such customer and to reflect the opinions of customers to our product development and/or service.
School Comms Lab would not disclose or provide personal information of customers collected by the “Contact Us” except for the following cases when:

Disclosure is required based on laws and regulations.
School Comms Lab keeps contact form submissions for up to 10 years for customer service purposes, but we do not use the information submitted through “contact us” forms for marketing purposes.

Email Newsletter
We provide the opportunity to sign-up for a monthly email newsletter by entering in your email address in a sign up form.
In some cases we may ask you for further information, such as name, occupation, address or telephone number. Regarding the processing of this personal data you will be asked to grant your explicit consent.
If you subscribe for our monthly email newsletter your IP address as well as data and time of subscription will be collected. This allows us to prevent misuse of our services or of the e-mail address of the subscriber. This data is only used for the distribution of the newsletter. The subscription may be terminated by you at any time by following the unsubscribe instructions included in each newsletter. We will delete the relevant personal data promptly upon your unsubscribe instruction.
Testimonials
We display personal testimonials of satisfied customers on our site in addition to other endorsements. With your consent we may post your testimonial along with your name and photo.
Who We Share Data With
When registering on our site, we may collect your name, email address or other information to help you with your experience. In addition, we provide social network authentication with Facebook and Google. When signing up with one of these services, you authorize us to access the information available on those profiles, including but not limited to: your name, date of birth, profile picture, gender, location, website address, and email address.
This information is collected at the time you register for an account on our site, update your subscriptions, subscribe to a newsletter, respond to any marketing materials, or fill out any other forms present on our site.
1. PayPal Payment Processor
If you choose to subscribe to the School Comms Lab membership, we may collect credit card or additional payment information from you. However, it is important to note that we do not store any of this payment information or process any of your payments on our servers, but rather use a third party payment service known as ‘PayPal.’ Therefore, any information regarding your payment processing and security must be verified in PayPal’s own Terms of Service Agreement and Privacy Policy.
The payment processor, ‘PayPal’, may provide us with unique authentication tokens to make payments requests with. The payment processor ‘PayPal’ may also provide us with information such as your name, credit card type, expiration date, and the last four digits of your credit card number. This information is used only to make single payment requests, or register the user for an ongoing subscription that requires automatic payments in the future.
In addition, School Comms Lab may also request and receive any payment history between the user and School Comms Lab.
2. Facebook Conversion Pixels
We use the “Custom Audience pixel” of Facebook Inc., (“Facebook”) on our website. With its help, we can keep track of what users do after they see or click on a Facebook advertisement. This enables us to monitor the effectiveness of Facebook ads for purposes of statistics and market research. Data collected in this way is anonymous to us, which means we cannot see the personal data of individual users. However, this data is saved and processed by Facebook. Facebook can connect this data with your Facebook account and use it for its own advertising purposes, in accordance with Facebook’s Data Policy which can be found at https://www.facebook.com/about/privacy/. You can allow Facebook and its partners to place ads on and outside of Facebook. A cookie can also be saved on your device for these purposes.

3. Google Analytics
Our website uses Google Analytics, a web analysis service of Google, Inc., www.google.com (“Google Analytics” or “Google”). Google Analytics employs cookies that are stored to your computer in order to facilitate an analysis of your use of the site. How Long We Retain Your Data
If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
For users that register as a customer or School Comms Lab member on our website, we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
What Rights You Have Over Your Data
If you have an account/profile on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us.
